Terms of Service

1. Acceptance of Terms

By using the Service, you confirm that you have read, understood, and agreed to these Terms.

We may update these Terms at any time. If we do, we will update the "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.

2. Description of Service

ArubaSave is an online platform that connects customers with local businesses in Aruba by offering discounted deals redeemable through digital QR code vouchers.

ArubaSave acts only as a technology and marketing platform. ArubaSave is not a seller, merchant, or service provider for the listed deals, and ArubaSave is not a party to any agreement between customers and businesses.

All products and services are provided solely by the participating business.

3. Eligibility

You must be at least 18 years old to create an account or use the Service.

By using ArubaSave, you represent and warrant that you meet this requirement.

4. User Accounts

To claim vouchers, you must register an account.

You are responsible for:

• maintaining the confidentiality of your login credentials
• all activities that occur under your account
• ensuring your registration information is accurate and updated

You agree that ArubaSave is not responsible for any loss or damage caused by unauthorized access to your account.

ArubaSave may suspend or terminate accounts that violate these Terms or misuse the Service.

5. Vouchers and Deals

For Customers

• Each user may hold a maximum of 3 active vouchers at any time.
• Vouchers are non-transferable and may only be redeemed by the account holder.
• Vouchers are valid only until the expiration date shown.
• Expired vouchers cannot be redeemed.
• Once a voucher is marked "used", it cannot be reversed or reissued.
• ArubaSave does not guarantee that a deal will always be available.
• ArubaSave does not guarantee that a business will always have availability (for example, fully booked days).

Redemption

Businesses may require that vouchers are redeemed during business hours and according to the terms of the deal.

If a business refuses redemption due to rule violations, expired vouchers, fraud suspicion, or misuse, ArubaSave is not responsible.

6. Businesses

Businesses must be approved by ArubaSave before listing deals.

Businesses are solely responsible for:

• the accuracy of their deal information
• honoring the listed discount and inclusions
• compliance with Aruban laws and regulations
• taxes, permits, and licensing
• customer service and service delivery

ArubaSave may remove deals or suspend business accounts at any time if:

• deal content is misleading
• the business receives repeated complaints
• the business violates laws or these Terms

7. Payments

ArubaSave does not process payments for goods or services.

Claiming vouchers on ArubaSave is free. Any payment for goods or services happens directly between the customer and the business at the time of redemption.

ArubaSave is not responsible for:

• payment disputes
• refunds
• chargebacks
• pricing issues
• business refusal of service

8. No Refund Policy

Because ArubaSave does not collect payment for deals, ArubaSave does not issue refunds.

Refund requests must be handled directly with the business.

9. Prohibited Conduct

You agree not to:

• violate laws or regulations
• create multiple accounts to bypass limits
• copy, duplicate, share, resell, or distribute vouchers or QR codes
• commit fraud or attempt to redeem vouchers dishonestly
• scrape, crawl, or harvest platform data
• attempt to hack or access restricted areas
• disrupt platform performance or security
• upload malware, viruses, or harmful code
• harass or abuse other users or businesses

Violations may result in account termination and legal action.

10. Intellectual Property

All content on ArubaSave (logos, branding, designs, software, text, graphics, and platform features) belongs to ArubaSave or its licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse engineer, or exploit any part of the Service without written permission.

11. Business Content and User Content

Businesses may upload descriptions, pricing, photos, logos, and promotional content.

By uploading content, businesses confirm that:

• they own the rights or have permission to use the content
• the content is truthful and not misleading
• the content does not violate copyright, trademark, or other rights

ArubaSave may remove any content at any time.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your personal data.

13. Service Availability

We may modify, suspend, or discontinue the Service (or any part of it) at any time.

ArubaSave does not guarantee that the Service will be uninterrupted, error-free, or always available.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

ARUBASAVE DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO:

• merchantability
• fitness for a particular purpose
• non-infringement

ArubaSave does not guarantee the accuracy of deal listings, availability, pricing, or business performance.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARUBASAVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes loss of profits, data, goodwill, business interruption, or any damages related to:

• voucher redemption failures
• business refusal
• customer dissatisfaction
• inaccurate deal listings
• technical downtime

ArubaSave's total liability for any claim relating to the Service shall not exceed USD $50.

Nothing in these Terms limits liability where such limitation is prohibited by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless ArubaSave, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• your use of the Service
• your violation of these Terms
• your violation of any law
• misuse of vouchers or QR codes
• disputes between customers and businesses
• content uploaded by businesses

17. Force Majeure

ArubaSave is not responsible for delays or failures caused by events beyond our reasonable control, including hurricanes, natural disasters, internet outages, cyberattacks, government restrictions, or power failures.

18. Termination

We may suspend or terminate your account or access at any time, with or without notice, if you violate these Terms or create risk to the platform.

Upon termination, your right to use the Service ends immediately.

19. Severability

If any part of these Terms is found invalid or unenforceable, the remaining sections will remain in effect.

20. Entire Agreement

These Terms and the Privacy Policy form the entire agreement between you and ArubaSave regarding use of the Service.

21. No Partnership

Businesses listed on ArubaSave are independent third parties. Nothing in these Terms creates an employment relationship, partnership, agency, or joint venture between ArubaSave and any business.

22. Governing Law

These Terms are governed by the laws of Aruba (Kingdom of the Netherlands).

Any dispute shall be handled exclusively in the courts of Aruba.
